Court martial proceedings initiated agains Lt Gen (retd) Faiz Hameed: ISPR

Court martial proceeding have been initiated agains Lt Gen (retd) Faiz Hameedm, according to a statement by the Inter-Services Public Relations (ISPR).

The former chief of the Inter-Services Intelligence (ISI) agency was reportedly taken into military’s custody.

A probe into complaints against the former spy chief was launched over the Top City case, following instructions from the Supreme Court of Pakistan.

Top city case

Earlier in April this year, Pakistan Army had constituted a high-level inquiry committee headed by a major general to look into the allegations against Lt-Gen (retd) Faiz Hameed that he as Inter-Services Intelligence (ISI) director general misused his authority.

The inquiry has been ordered in pursuant to the orders of the Supreme Court and in the light of the directives of the Ministry of Defence, according to the people familiar with the development.

This is the first formal inquiry ordered against Gen Faiz, who resigned in November 2022, four months before his retirement date.

Faiz served as DG C in the ISI and later headed the spy agency. His name surfaced in many controversies, including the Faizabad Dharna case. Three-time former prime minister Nawaz Sharif named him and Gen Bajwa as the main characters behind his removal through a Supreme Court order.

On November 8, 2023, Moeez Ahmed Khan, the owner of Top City, filed a petition in the Supreme Court in which he accused Faiz of misusing his authority.

The petition filed by in the Supreme Court stated that on May 12, 2017, on the behest of Gen Faiz, ISI officials raided the top city office and his house. During the raid, valuables, including gold, diamonds and money, were seized from the house by ISI officials, the petitioner alleged.

The petition also stated that Sardar Najaf, the brother of Faiz, also contacted him to resolve the issue later.

The petition also claimed that Gen Faiz later personally met him to resolve the issue, in which he assured that some of the items which had been taken away by the ISI officials during the raid would be returned. However, 400 tolas of gold and cash will not be returned to him.

The petitioner also alleged that the ISI officials extorted Rs4 crore cash from him.

Considering the sensitivity of the matter and in view of these serious allegations, a three-judge bench of the Supreme Court, which included Chief Justice of Pakistan Justice Qazi Faiz Isa, Justice Attar Minullah and Justice Aminuddin, heard the case.

The Supreme Court observed this was a very serious matter and the serious nature of allegations may damage the image of the entire institution, therefore the matter cannot be ignored. The Supreme Court asked the attorney general to look into the matter and discuss with the relevant authorities.

Bangladesh violence has resulted in the death of over 400 in the last month.

The Chief Justice of Bangladesh, Obaidul Hassan, resigned today following massive protests by students who surrounded the Supreme Court. Mr Hassan agreed to resign “in principle” after an ultimatum to do so from protesters. He was appointed to helm the Supreme Court last year and is seen as a loyalist to ousted premier Sheikh Hasina.

Hundreds of protesters, largely comprising students, surrounded the Bangladesh Supreme Court, demanding the immediate resignation of Chief Justice. The situation escalated rapidly, with reports suggesting the Chief Justice fled the premises before announcing his resignation.

The Bangladesh protests were sparked by a full-court meeting called by the Chief Justice without consulting the newly formed interim government. Student protestors alleged that the judges of the court are part of a conspiracy, prompting outrage and demands for accountability.

As tensions mounted, the scheduled full-court meeting was abruptly called off. Protestors, undeterred, continued to besiege the Supreme Court, giving the Chief Justice a one-hour ultimatum to step down.

The fresh protests come days after a student-led uprising against government hiring rules resulted in Nobel peace prize winner Muhammad Yunus taking charge of a caretaker government.

At least 450 people were killed in more than a month of deadly protests that ended the autocratic rule of 76-year-old prime minister Sheikh Hasina.

Hasina faces allegations of murder, forced disappearance, money laundering and corruption, and must face the law, Amir Khosru Mahmud Chowdhury, a senior member of Bangladesh Nationalist Party said.

Hasina, one of Asia’s longest-serving leaders, resigned and fled Bangladesh on August 5 under pressure from millions of protesters who had taken to the streets for weeks to demand she step down.

An interim government was appointed in Bangladesh Thursday, led by Nobel Prize-winning economist Muhammad Yunus. Under the constitution, an election needs to be called within 90 days, although Yunus, the military – which backs the interim government – and the president haven’t commented on when elections will be held.

The college argued that the ban was in place to ensure that the students’ religion was not disclosed.

Coming down heavily on a Mumbai college which had barred students from wearing burqas and hijab on campus, the Supreme Court asked the institution’s authorities how they were empowering women by telling them what to wear. In a stinging observation, the court also remarked that it was unfortunate that such bans were imposed even so many years after Independence. 

Hearing a petition filed by nine girl students against the ban on burqas, hijab, niqab, caps, stoles and badges imposed by the NG Acharya & DK Marathe College in Mumbai’s Chembur on Friday, a bench of Justices Sanjiv Khanna and PV Sanjay Kumar partially stayed the order. It said hijabs, caps and badges would be allowed and added that it hoped that the order would not be misused.

When the hearing began, Senior Advocate Madhavi Divan, appearing on behalf of the college, said that if the petitioners were allowed to wear hijabs and burqas, other students would come wearing saffron shawls to make a political point and it did not want that to happen. 

“Will you ban girls wearing a bindi or tilak?” the bench asked. 

The lawyer for the college said that there were 441 students from the community in the college and when a girl wears a veil or an article of clothing like that, it creates a barrier between her and the other students. She also pointed out that changing rooms had been arranged for the students to take off their hijabs or burqas before entering. 

“You may be right (but) the background they come from, family members may say wear it and go and they have to wear it. But everyone should study together,” the court said. 

‘Suddenly Woken Up’

“How are you empowering women by telling them what to wear? What girls want to wear should be left to them. Where is their choice? You have suddenly woken up that they are wearing it? It is unfortunate that after so many years of independence, such a ban is being talked about,” Justice Kumar said. 

When the college argued that the ban was also in place to ensure that the students’ religion was not disclosed, the court remarked that religion is revealed by names as well and stressed that such rules must not be imposed. 

Noting that wearing a burqa could not be allowed as students could not sit in class like that, the court partially stayed the circular and said, “We issue notice in the week commencing November 18. We partly stay the impugned circular to the extent that it directs that hijab, caps and badges will not be allowed. We hope and trust this interim order is not misused by anybody.”

The girls had approached the Supreme Court after the Bombay High Court had rejected their petition.

Manish Sisodia Leaves Jail In Delhi Liquor Policy Case After Supreme Court Grants Bail Months His Arrest In Liquor Policy Case

New Delhi:

AAP leader Manish Sisodia was released from Delhi’s Tihar Jail Friday evening – even as the dark clouds hovering over the national capital all day broke to shed much-needed rain – hours after the Supreme Court granted the ex-Deputy Chief Minister bail in the alleged liquor policy scam.

Mr Sisodia – who held multiple portfolios while a member of the Delhi government, including Education – was received by jubilant AAP supporters. And standing in the rain, he gave a short speech.

“Ever since this order came in the morning, every inch of my skin has been feeling indebted to Babasaheb (Ambedkar). I don’t understand how (I) will pay this debt to Babasaheb…”

“I have come out of jail due to your love, God’s blessings and the power of truth, and biggest of all, the dream of Babasaheb – that if any dictatorial government comes to power and puts Opposition leaders behind bars by forming dictatorial laws, then this country’s Constitution will protect them…”

“I assure you, with this power of the Constitution, (Chief Minister) Arvind Kejriwal will come out of jail as well…” Mr Sisodia said, after which he left for Mr Kejriwal’s residence in Delhi’s Civil Lines area.

Mr Sisodia was given bail on his eighth appeal. He was, though, allowed to visit his ailing wife last year.

Like himself, the Chief Minister was arrested, in March, by both federal agencies in the liquor policy case. Mr Kejriwal has received bail in the case filed by the Enforcement Directorate but not the CBI.

Earlier today, in a series of powerful observations the Supreme Court called Mr Sisodia’s nearly 18-month incarceration a “travesty of justice” and asked tough questions of the trial court and the Delhi High Court for not considering the violation of his right to liberty by keeping him “behind bars for unlimited time”. Mr Sisodia was arrested by the CBI in February 2023 and by the ED 12 days later.

“In a matter pertaining to the life and liberty of a citizen – which is one of the most sacrosanct rights guaranteed by the Constitution – a citizen cannot be made to run from pillar to post,” a bench of Justice BR Gavai and Justice KV Viswanathan had said.

Mr Sisodia could not be made to run “from pillar to post” for bail, the court said.

Mr Sisodia’s party has welcomed his release, calling it “victory of truth”.

Rajya Sabha MP Raghav Chadha, in a euphoric post on X (formerly Twitter), declared “the entire country is happy today as Manish Sisodia, hero of the Delhi education revolution, got bail.”

“This verdict is a slap on Centre’s dictatorship. He was in jail for 17 months. His life was destroyed in those months. He could have worked for education of children in that time,” Sanjay Singh – who was also arrested, and later granted bail by the top court, in this case – said.

“Satyamev Jayate,” Delhi Education minister Atishi posted on X.

Top Court Slams Lower Courts Over Sisodia

In releasing Mr Sisodia, the court also made critical observations on the federal agencies’, one example of which was Justice Gavai saying, “In this case 493 witnesses (were) named (and) there is not remotest possibility that Manish Sisodia’s trial will conclude in (the near) future.”

On the question of Mr Sisodia allegedly tampering with evidence, the court pointed out “most evidence is documentary” and that these documents were already with the probe agencies.

The court has, though, imposed certain conditions on Mr Sisodia, including demanding he surrender his passport and report to the Investigating Officer every Monday.

The court has also warned Mr Sisodia he will be returned to jail if there is tampering of evidence.
